Calif Dredge Permits halted on 7/27/09

Judge Roesch clarified his injunction on Mon 7/27.
His reasoning is that if a person is behind the counter and the lights are on in the building, then tax payer money is being used. Therefore the DFG in Ca. stopped issuing dredge permits.

Figures. I was standing in the parking lot of the Redding office to buy a permit on Friday, July 24,..............but the lights were off and nobody was at the counter. Evidently F&G has been closed the last three Fridays as a cost-saving measure.

That's the nice thing about judges,......................they don't have any trouble twisting to justify what they already think just to make it look right.

Hmmm,...

If that is his reasoning, it provides very telling insight as to his ability to reach decisions that are rational, fair and equitable for all, under the color of law.
(…And he is a judge…)

I wonder how (in his mind) he separates/justifies the other over the counter business that is done during the office hours of operation, when the same wages and utilities costs are being incurred?

That is strange as the DF&G sent a letter to the judge asking for more clarification as they do no use any of the general fund moneys to issue the permits. the only money they use to issue the permits are the monies of the permit themselves. So they do not use an general fund money which is what he told them to stop doing.

We shall see Come on folks give more of your money to the guys at PLP and other places to fight this stuff. I gave Jim $200 dollar of my own money and don't tell me how much I must have. Guys I am on work comp and only take in $166.67 per week total income.

So did they cut the enforcment too? If there is no one to catch you why do you need a permit?

Dredging without a permit is a misdemeanor, I think.

I've heard guys paying 700 to 800$ in fines for fishing without a licence. I just paid 135.00 for a no seat belt ticket. As hungry is this state is for money, I would imagine they will make it up as they go. Mark

Probably 1 million dollars so the governator can eventually pay off his debt.

Funny how they shut down something that can & does bring in income.. Whats up with that?!

The governor hasn't signed the bill as of this writing...most of the fines and penalties are up to the judge,such as in illegal abalone fishing..they can take all your equipment,your vehicle,fine you,jail you..but the good news is they can't deport you to Mexico or Iraq...not yet.How long before one has to remove their boots before leaving your vehicle to take a hike in the woods,and then don't inhale any mosquitos or break wind on a non-burn day..good night from Kali...Dave

How about if I was a illegal than all I would get for a fine would be free education for my kids, free housing, free health care and if I had an idea on a business maybe a check to start my own company! What do you think???

Then, I would say you are just what the powers in control of our country are looking for. Did you get to vote in the last election???


Just caught myself violating one of the most annoying cardinal sins on a forum, which is hijacking the subject of a thread. The problem is this happens all too often and it screws up the thought process of the other posters.
