This is a little complex. And I would rather not get into legal discussions on this forum. So I have asked our attorney to provide us with a memo.

Meanwhile, here it is as I understand it:

The mining laws allow all Americans free access on the public lands for the purpose of prospecting. There is no requirement of making contact, getting permission or giving notice to the authorities until such time that we believe our activities will create a substantial surface impact.

We are only required to file a Notice of Intent (NOI) with the U.S. Forest Service (USFS) if we believe our prospecting may create a substantial impact. Filing an NOI is not a requirement. There is no penalty for not filing an NOI.

Once (if) an NOI is filed, the USFS Ranger used to go through an internal process to assess if what we are doing is likely to create a substantial surface impact. Now that this Decision is final, the Ranger is required to consult with other agencies to perform this assessment.

In 30 years in the Klamath National Forest, the Happy Camp, Scott and Upper Salmon River Rangers have never once considered that The New 49'ers, even as a whole group, may create a substantial surface impact.

Therefore, as an individual, I don't know why anyone doing small-scale prospecting would believe an NOI would be necessary.

Because if you file one, the Ranger will now be required to go through some kind of extensive inter-agency consultation process which could take a long time.

The gov't is going to take away our rights eventually. They just have to figure out how they can win all the environmental cases- and get Agenda 21 implemented thru the UN.

Agenda 21 and any UN....a foreign entity step foot on our soil and try to police our ground will be that flashpoint that Dave Mack has been talking about.
This is from a city boy...rural America needs to step it up and fight the righteous fight to keep our rights, our lands, and our Freedoms.
If the government thinks that drones, Fema camps, and UN thugs will keep us down...fhqn think again.
Here's one Red Blooded American bad ass that will lay his life Down to fight that from happening.

As a TEXAN I am also ready at the call. I love our AMERICA and still proud of our country. I just think any CHANGES to be made needs to come with knowing all angles of any issues, and not rely on biased onesided information just because they scream it in your ear, throw money at it or know somebody who owes em a FAVOR and the being to pressured OR LAZY or BUSY to seek the Whole Truth for what it really is even if it becomes a bit difficult when some arent happy in that Truth.

Sorry for the soapbox NOT!
As I wrote a couple of years ago to the Fish and Game Mr.S about the facts of boatmotors and overfishing, weights and gas dripping from careless fueling of watercrafts was the turbiditys along with Natural rainfall snowmelts and flooding are the main sources of what the enviros blamed on dredging maybe more research should be done to compare what ratio really is causing those issues . and could he imagine what kinda hornets nest would that stir up by stopping boating ,fishing, and watercrafts?
My Husband and Myself have worked the past years in a windowless kitchen paying our taxes looking forward to one day being able to live a dream of being able to Prospect for gold and hopefully ink out a small living from it and as that day getting closer we bought the trailer the 4X4 and almost equipt for that dream yet now the No dreging and the regulations becoming strict with each year passing I do worry will ever be possible
