Judge Dixon's TRO... What's Up? ( 23:33:26 FriAug 16 2013 )

I don't understand.

I've read Buchal's memorandum. Jim Foley on Wednesday evening stopped by my camp on the Klamath River. He advised me to remove my GTS. I intend to keep my GTS working.

Do I have protection from CDFW or not?

I need a simple straight answer on this. I'm under the assumption that I am legal and need not fear CDFW. I'll be here at home in Redding until Monday morning at which time I'll be back in the Klamath River transferring gravel.

Something ain't right here.

On Wednesday, August 14th, Dave Mack responded to a previous inquiry regarding the use of suction mining and the use of the gravel transfer system. This was copied from that post.

"I gather that DFW will begin enforcing the new expanded definition of "suction dredging." We are advising the few remaining underwater miners to remove underwater suction mining gear. Of the few remaining underwater miners, I gather most have them have already converted to crevicing, some with the assistance of a pressure nozzle."

The information that Mr. Jim Foley gave you is correct, and the continued use of suction mining equipment would be at your own risk.

Thanks Rich,

I did read that post from Dave.

What about the Dixon TRO?

If it's still good, then I would be safe from CDFW.
If it's not good, CDFW wins again.

At my own risk?
I believe the Judge took that off the table.
CDFW is at risk.

Is there any sort of news concerning "dissolving" the TRO?
Buchal's memo is 2 weeks old today.

Thanks Salmon,

Support is the only thing I need. Keep your money. We'll balance the scales eventually.

Am I and Judge Dixon the only 2 people of Siskiyou County who are in focus on CDFW? No, course not.

Time is wasting, the sun is leaving the Klamath River for the season. Delay is impossible.

As long as my handmade GTS is collecting the gold, I'll be attempting to transfer gravel thru it. What could be more factual than that?

Can somebody please explain the status quo of Dixon's TRO?

Sorry Rod, We have provided you with everything we know.

We normally would not entertain a legal discussion on this forum. But we understand members are trying to figure out what to do.

Anything else would just be speculation. Welcome to California, the land of legal uncertainty!

Dave said -- "Welcome to California, the land of legal uncertainty!"

And the land of herd mentality.
