Fellow members I have bought a claim on the Kern River only to be told by forestry that a rafting company has the area leased and unless they give us written permission I cannot use the forest service gate and road to the claim. How do I handle this? The forest service will not accept my noi without a letter from rafting company. (not holding breath on this) would appreciate any input. thanks Merry Christmas and Happy New Year.....Perry

Rafters don't have the right to "lease" over your Federal right to access to your claim. If I was you..I would find an upstream access point and float to work.
Let me know if you need some on site support. ..the Kern is not too far out of my way so willing to help. This Saturday 12/21 there will be a PLP membership drive in Temecula which I will attend and I will post Jerry or Walts answer after I present question to them. Be in touch Perry John B |

Perryaw, ask them for a copy of this so-called lease and post it on this forum for all to see.
Also, get their denial in writing. (And the ranger's name.) Something here smells to high heaven. Just sayin'..... |
