Federal Court decides in favor of miner over USFS! ( 10:05:30 SunNov 13 2011 )

Our attorney, James Buchal, just won an interesting case where the Forest Service (USFS) had bulldozed a miner’s cabin, mill and outbuildings after protracted non-resolution of a bonding dispute.

The Forest Service claimed it could lawfully do this, based upon using a “personal property” impoundment regulation. The District Court decided otherwise.

It's nice to win one once in a while!

That is great news! What was the summary judjement in favor of the Plantiff? Does the USFS have to re-construct or re-pay the owner for his structures?

Mark: I read the whole legal, and it sounds like the lady judge did find for the miner---yet she also gave the lady district forest ranger and her cronies a break. GO FIGURE!!!!!
Could not decide if the miner will get any relief financially or not. Beammaker
