I have been reading and trying to understand the mining laws, It seems that when you are on "club claims" the laws change according to what the contracts to the blm/fs have been made out. I have all the clubs rules, but with that I still have questions as to where we stand as members when or if we are aproached by law enforcment while prospecting on club claims.
I have all the mining laws and amendments printed out and put in a book to carry with me, but my understanding is that alot may not apply. Where do I go to get simple answers, (not legaleeze) in plain english (probably why I am not a lawyer) so that I can prospect in a legal and unhindered way. (with respect to club rules). With the new rules in respect to water, (permits) where do we stand. I have read (other forums) alot of nasty talk about our club, are we in fact doing something wrong? or as I assume, there are those folks out there just bad mouthing just because they have a personal gripe. I'll stop here but lots of questions. pm if it is not appropiate to post answer on the open forum. Rick |

The club rules conform to existing laws and regulations from various authorities. Stick to the club rules and you won't go wrong. The club does all the paperwork and permit stuff for you. That's why we call it "hassle free mining".

I will add a little bit pertaining to your question of what to do if you are approached by BLM/ USFS while on a club claim.
The best move is to simply ask the officer to contact Richard Krimm -- Richard's job is to liase with these agencies. The agencies in the Happy Camp area know this, and unless you are engaged in some blatant violation that warrants an immediate citation, chances are they are going to contact Richard or Dave first anyway. This has been the way it has been in the past. No matter what, remain courteous and compliant; do not admit to anything; do not get belligerent or try to "explain the law" -- that only pisses them off and guarantees that you will get cited (or worse). Like I said, though, the officers in our area have dealt with the club for a long time and know who to contact should there be a need. That being said, I have been approached by a couple of USFS personnel without knowing who they were -- they were friendly, and actually acted like miners. I can't remember his name, but last season one of the big-wigs came out to the E-3 claim and checked out my high-banking operation -- I didn't know who he was until about 10 minutes into our conversation! Like I said, chances are you won't even be approached -- but if so, just use good common sense and you'll be fine. |

The Club's Operation Guidelines have been worked out with the authorities so that our cumulative impact remains in the comfort zone which does not require umpteen years of studies and approvals by multiple government agencies. These guidelines have not changed much since we started in 1986.
Everybody that joins our program signs an Agreement to stay within these guidelines when present on our properties. In the 26 years we have been going, I am not aware of a single member who was harassed or cited while staying within our guidelines. Approaches by the authorities are few and far between, and always friendly. You can put all your mining law materials away for another day unless you intend to go off and do your own program on property which we don't manage. You won't need them on our properties. We already have a substantial, very qualified legal team that helps support and defend our program. I wouldn't be too concerned about the opinions of others. Someone always has something to say. It's what people do that really counts. |

Doesn't hurt to be carefull and stay up on all the rules as they seem to change them daily Rick |
