California Department of Fish & Wildlife (DFW) denied the recent Center For Biological Diversity's Petition today which attempted to expand the regulatory definition of "suction dredge" to include our new method of underwater suction mining.

Amongst other reasons for denying the Petition, DFW pointed out that the Karuks and their allies had plenty of opportunity to expand the regulatory definition when they participated in the multi-million dollar administrative process that was formally completed about a year ago.

I will post the Decision right here as soon as I can get it on line.

It is nice to win one every once in a while. This would appear to provide the green light for what is adding up the be a productive mining season in California!

When Dave makes the ruling available, it would be good for everyone to read it carefully. Although this is a good and definite win for our side :doublethumbsup: it would be in our best interest to make sure that we mine in a responsible manner and don't give anyone any reason to blast us, or do anything that could, at some future time, be the cause of even more restrictive regulations.

It can be seen from reading this document that the state is not going to just roll over. They will be addressing things of this nature in the future, such as, "what does it mean to be dredging".

In this respect it is important to remember and not be short sighted regarding the possibility that dredging will be restored in the future. If and when it is, there will be new regulations put forth.

We have this opportunity to show that miners can and do, do things the right way, regulations or not. Now when the new comment periods open for any new regulations, we can have a positive influence on them.

In regard to this recent petition that was denied, I can say with all confidence that, "Out of adversity comes opportunity". Let's take advantage of the opportunity at hand.

I would have to agree with Jim on his point.

The reply makes it clear that if your operation is creating harm, there are other ways CDF&G (now California Dept Fish and Wildlife DFW) will deal with you.

However, it is nice to finally see DFW use some common sense.

Basically DFW says that all these issue are involved in legislative and judicial processes and it is up to those people to resolve it.

Yeah at some point enough is enough, it's also nice to be validated that us small scale miners didn't cost the State of California millions of dollars............. the Karuks and their allies did!!! :thankyou:

Yep good news. This victory has a refreshingly envigorating positive assumption associated with it. It seems like CDFW has attempted to right some previous wrongs.

It wouldn't hurt my feelings if the CA legislature decides to NOT address small-scale mining ever again.

I'm loading my trailer and almost ready to roll.

I am very pleased to hear this news, and I am very happy to say I will be on my way in a few days. I have started assembling all of my gear and preparing the RV for travel. I am waiting for a rifle delivery and will leave as soon as it arrives. I hope it will arrive on Wednesday...

This is exciting! Can't wait to get on the river. We have our suction system together and it doesn't include a sluice so it'll be a nice quiet 5 months on the Klamath!
