I'm in for a oz.or more if we can get our names on the law suit, so that we have a chance in getting it back in damages.
I also like the idea of voting on a legal fund dues that would be added to our regular membership dues.
I usally donate anonymous to the fund raisers and legal fund but would like to get my name on the law suit for the money spent on a out of state dredge permits and loss of revenue from not being able to dredge in the 09 dredge season. SB 670 was signed one week before I drove 2367 miles. I really did not expect the bill to get signed being that AB1032 was vetoed, but this goes to show you what big money can purchase.
With the future of dredging now on the chopping block, I do not understand why there has not been more donations to the legal fund.

Now its starting to look like its climbing up some. I would like to see the class action lawsuit have everyone's name on it. Damages for loss of gold, pain and suffering/mental anguish, dredge permit fee returned. Size restrictions on dredge nozzles returned to 15 inches. High bankers nozzles 5 inches, with increase on engine size on both. Dont forget its 35k just to retain the lawyer. For that kind of money lets get some things other than just getting back in the water. And how about some floating trommels. All lawyers fees and our money back from the lawyer's fee. So it sounds like about 6k or there abouts is where we are up to. Lets watch and see whose next.

6k wont be enough, at this rate it will take over year just for the retainer. And without the large donations,just going off of small donations, its looks like over 2 years at the rate its going and that's just for the retainer. I hope PLP wins, my 2k is going elsewhere. Sorry, but the large and small donations has been going on for a month to get 6k. Take out the large donations, whats left 1k / 1500.00 maybe. Not even close for a retainer, much less a federal lawsuit. No im not quitting, im just going to get behind something that's already got some momentum. Dont want to waist time waiting around for a year to start a lawsuit.

Well,
I for one am in this fight to the end. I don't personally care how long it takes to get a lawsuit filed by Dave at this point in time because there is already one filed by PLP.

I would feel different if the PLP lawsuit were not filed.

It might be better in the long run to wait for some action in the PLP lawsuit to see what type of defense CDF&G and the State of Cal are going to try and use to defend themselves.

We have two years I believe to file a lawsuit against the CDF&G and the State of Cal, Dave correct me if I am wrong?

At this point in time, if Dave files a lawsuit, I am still interested in possibly being listed as a plaintiff, and would like to know just what it would take to be listed as one? There have been financial damages caused to many people by the actions the Cal gov and courts have taken, and I for one am interested in making them pay for that.

I am also aware that federal "Takings" lawsuits can drag out for more than ten years.

I just got off the phone with the 49ers lawyer James. Got my questions answered. Your answers will probably come in the spring. Good or bad. I now have a better understanding of the time constrains and costs and why things might take a touch longer.
